Yet ANOTHER Nail in the Digital Gateway Coffin

Dear Coalition Supporter and Friends,

If it felt like Groundhog Day yesterday, with yet another LOSS for the PWC County Board and Digital Gateway Developers, QTS and Compass, you would be correct. 

Judge Irving removed all hope that she would “stay” her decision to “void” the Digital Gateway rezoning, thus preventing destruction of the Pageland corridor to commence, while all appeals were going through the appeals process.  Remember, there are TWO lawsuits against the Digital Gateway.

“After the hearing, Mac Haddow, president of the Oak Valley Homeowners’ Association, said the plaintiffs are pleased with the judge’s decision to deny the stay.”

“The judge just affirmed what we have said all along — that this is a very simple matter,” he said. “A factual finding was made by the judge that the procedures were not followed by the county.” 

“Haddow also said the rulings are a victory for all county residents… 
I think that it empowers citizens to speak up.”

“Prince William County Circuit Court Judge Kimberly A. Irving on Wednesday denied a motion requesting a stay of her Aug. 7 ruling that voided the PW Digital Gateway project, granting the Oak Valley plaintiffs another victory ahead of a potential appeal.”

“If granted, the joint motion filed by defendants and the Board of County Supervisors would have allowed preparations for PW Digital Gateway data centers to proceed as planned pending the conclusion of the appeal process, which may take upwards of a year.”

The Oak Valley HOA and citizen plaintiffs are a key brick in the firewall that protects western Prince William AND the state from the wide-ranging impacts this kind of industrialization would bring, both near AND far.

What’s next? Who knows.  Will the county board appeal this ruling? Will Compass and QTS appeal?

AND of course, there is yet another brick in the firewall.  The other lawsuit filed by American Battlefield Trust and citizen plaintiffs awaits its day in front of the Virginia Court of Appeals!
